You can download the text of the Deed Restrictions for Garden Oaks, by Section. PDFs of the Recorded Documents are shown by PDF symbol . A transcription of the deed restrictions is provided for readability and convenience as a Word Document . These Word Documents are updated Transcriptions which more closely reflect what is in the original Recorded Documents including misspellings and odd punctuation. We have tracked the changes from the old transcriptions so you may see the changes by turning on Markup. Amendment A is the amendment to the deed restrictions that created GOMO, and should be downloaded with the deed restrictions for sections 1, 2, 3, and 5 in order to have the complete deed restrictions for those sections.
*Note: Section 4 is continuing their effort to join GOMO. While section 4 does not have GOMO to help with its deed restrictions, the deed restrictions for that section are still valid and enforceable.
Sign Policy (Draft) - GOMO is seeking member input on a draft Sign Policy. This Policy is intended to replace the requirement in the Deed Restrictions that ALL signs be approved by providing blanket approval for many of the most common types of signs. There are three director positions per section on staggered three year terms so there is at least one position per section up for election each year.

In addition to and as required by the Texas Property Code and Non-Profit Incorporation laws, GOMO operates under a set of bylaws. These bylaws were designed to make GOMO an organization that is responsive and open to the needs of property owners in Garden Oaks. You can download the current GOMO bylaws (PDF).

Section 3 Garage Case - Board Action Aug 11
On July 6, 2016 the Notice of Appeal was filed and assigned to the 14th Court of Appeals. The record of the trial which is made up of the reporter’s record and clerk’s record were being transferred to the court of appeals in late July and early August. Generally, both an Appellant’s and Appellee’s brief will be filed. An Opinion from the court may take 18 months to two years. The Board will review all questions submitted here and reply to as many as possible. Answers will be posted to the website as soon as practical.

GOMO reviewed and adopted a budget for 2017 at its business meeting held August 17th. Major changes from prior year’s budgets include the elimination of spending of “Surplus Funds” as required by the bylaws for FY 2016-2017. These funds have been used for neighborhood related items such as Constable Patrols and Neighborhood Beautification.
In practical terms, this means that next year Garden Oaks will lose the two Constable Patrols funded by GOMO (cost $153,500) and Beautification funding (cost $20,000). These steps were taken as a result of the outcome of the Section 3 garage lawsuit. While the lawsuit found GOMO to be improperly formed only with respect to the homeowners in the lawsuit, out of an abundance of caution, GOMO decided to place all transfer fees and other income received after the judgment date, June 8, 2016, into a separate account.
GOMO appealed the ruling and is confident that the appeal will establish that GOMO was and is properly formed and that it has the authority to enforce Deed Restrictions and collect Transfer Fees. However, until such time, GOMO will limit spending to deed restriction enforcement and operating expenses.
Due to its contractual obligations with Harris County, GOMO will continue to fund the two Constable Patrols until February 28, 2017.
